General Terms and Conditions of Supply
1.- SCOPE OF SERVICE.
The visa management service consists of advising the client appropriately to facilitate the management process, including, where possible, the submission of the application on their behalf.
In each case, the scope of the service will be as specified in the relevant offer.
It is at the discretion of the different consulates to grant any visa, regardless of the information and documentation submitted with the application. For this reason, CUCALON ESTEVEZ SERVICIOS DE VISADOS Y LEGALIZACIONES SL, with tax ID B75375121, registered in the commercial registry sheet M-836839, Volume 0, page 0, entry 1, with address at Travesía de San Juan 3, Miraflores de la Sierra, Madrid (28792) (hereinafter referred to as “VISAS”) does not take responsibility for the final granting of the visa, as its responsibility is solely the submission of the application on behalf of the client.
In cases where the client has not contracted documentary advice, and is therefore directly responsible for the quality of the requested documents and their suitability for consular procedures, if the application is rejected due to any kind of defect in the aforementioned documents at the time of submitting the file, VISAS will consider that the service of submitting the file has been provided. If the client requests the possibility of correcting the errors and thus making a new submission, the client will be entitled to request a new management service fee.
2.- RETURN AND REFUND.
In the event that the client withdraws from the hiring of the service before completing the application process, VISADOS will evaluate the percentage of work effectively carried out and will generate a compensation voucher for the estimated amount that the client can redeem for the total or partial hiring of new services.
The denial of a visa, regardless of the reason, will not entitle the client to claim the refund of the amounts paid for the services rendered, as well as any corresponding amounts advanced as payment for fees.
3.- DOCUMENTATION COLLECTION AND DELIVERY POLICY.
It is the client’s responsibility to deliver the necessary documentation to VISADOS in the manner they deem most appropriate, within the established timeframe and format. Likewise, it is their responsibility to collect the visa at the VISADOS offices once it is ready for pickup. In cases where the client requests the services of document collection and/or visa delivery, VISADOS will subcontract these services to a courier service, including one indicated by the client. This will be done on behalf of the client, and VISADOS will not be responsible for any incidents that the courier may generate.
VISADOS is responsible for communicating the delivery timeframes committed by the courier company.
In carrying out its activities, VISADOS is not responsible for the possible loss of any document or delayed deliveries compared to the expected timeframes, as long as the responsible party is the courier company, providing the client with all data and information necessary to claim damages caused by delays.
4.- VISA EFFECTIVENESS.
The granting of a visa does not guarantee entry into the destination country in any case, as this is subject to examination and the subsequent decision of the corresponding customs official.
5.- MANAGEMENT DEADLINES.
The management deadlines listed in all offers prepared by VISADOS should be considered indicative, as consulates reserve the right to change them without prior notice and to adapt them to the specific workload levels they may be subjected to. Therefore, it is solely the client’s responsibility to purchase flight tickets prior to the granting of the visa and the accompanying risk of losing them.
In cases where the client has urgent travel dates, it is their responsibility to communicate these to VISADOS and ensure that the deadlines committed in the offer are compatible with their needs.
Furthermore, the client agrees to provide VISADOS with the necessary documentation within a reasonable timeframe that shall never exceed two months from the acceptance of the quote.
After this period, if the necessary documentation to present the application has not been received in full and suitable form, VISADOS may consider the service provision concluded, with the client having no right to claim any amount beyond the fee amounts.
6.- ADVERTISING OF THE RELATIONSHIP.
By accepting the offered services, the client authorizes VISADOS to make public the aforementioned contract, as well as to include the client company in its commercial references. If the client does not wish to make the relationship public, they must notify VISADOS in a verifiable manner; once such communication is received, VISADOS will have 60 days to remove all references.
7.- PAYMENT OF FEES.
Since many of the fees are paid in foreign currency, the final amount in euros is subject to the fluctuation of the exchange rates between such currencies. If, due to the exchange rate, the final amount paid for the fees is higher than the amount stated in the offer, VISADOS will have the right to demand the difference upon presentation of the final payment receipt for the same.
8.- RETURN AND REFUND.
In the event of a withdrawal by the client, delivery of the technical sheet containing all key information related to the corresponding visa will generate a cost of 50% of the budgeted amount for the management, to be paid by the client in all circumstances. If more procedures or actions have been carried out, including part of the advice, support visits to the consulate, client-specific inquiries, etc., VISADOS will have the authority to assess what percentage of the total management costs should be charged, regardless of whether the process has been completed or not, potentially reaching up to 100% of these costs. If the client has paid the full amount for the services at the time of their withdrawal, VISADOS will proceed to refund the corresponding part. Provided that these services have not been paid for, amounts corresponding to uncompleted fees or services, such as document or passport delivery and others of this nature, will be refunded to the client.
